Terms & Conditions revised as of 11/29/2004
These Terms and Conditions constitute the Agreement between
you and your group (collectively "Passenger") and RHONE CROISIERE SARL
as well as its employees, officers and directors (collectively RHONE CROISIERE).
CRUISE INCLUDES
Accommodations with private bath and lavatories, all
meals and beverages on board, round-trip transfers from specified meeting
point, use of bicycles and other facilities of the boat, excursions, sightseeing
and related admittance fees unless otherwise specified.
CRUISE DOES NOT INCLUDE
Air and train transportation, hotel before and after,
airport taxes, health or accident insurance, trip cancellation insurance
and baggage loss (all strongly recommended). Items of a personal nature
such as passport, laundry, purchases or gratuities for the crew. In business
configuration, are not included all specific materials and equipments as
video equipments, sound systems, screens and boards, etc.
BOOKING AND CANCELLATION INFORMATION
Rates in US Dollars apply to US residents only.
A deposit of 30% of the price is required at the time
of booking. A reservation cannot be confirmed until the deposit is received
in the RHONE CROISIERE office with the properly fulfilled and signed "reservation
form". RHONE CROISIERE can send confirmation by E-mail. Final payment is
due in the RHONE CROISIERE office three months prior to departure.
CANCELLATION CHARGES
Individuals:
All deposits and payments are not refundable.
No refund for unused portions of cruise.
Charters:
All deposits and payments are not refundable.
No refund for unused portions of cruise.
Note: Bookings are automatically cancelled if money is
not received on time in the RHONE CROISIERE offices and penalties as per
cancellation charges will be applied.
All cancellations must be done in writing and are effective
only upon receipt by RHONE CROISIERE office.
CANCELLATION BY RHONE CROISIERE
RHONE CROISIERE reserve the right to cancel any trip
21 days or more – unless force majeure - before departure. In the event
a trip is canceled by RHONE CROISIERE, its sole obligation is to refund
all monies paid it.
Individual reservations: unless otherwise specified, departure is guaranteed if at
least 6 passengers are booked. Otherwise, 21 days or more before departure,
RHONE CROISIERE will have to inform the Passenger and may:
1. maintain the departure, or
2. propose a departure date change, or
3. propose to cruise on an equivalent barge in the same
cruising area at the same cost, or
4. propose a price increase of the cruise
In cases 2. 3. and 4., if the Passenger refuses the change
proposed, his cruise will be canceled and he will be refund all monies
paid it, neither the Passenger nor RHONE CROISIERE will then have to pay
cancellation charges.
TRIP CANCELLATION INSURANCE
RHONE CROISIERE recommend adequate personal and baggage
insurance. Trip cancellation insurance is strongly recommended for all
Passengers. |
WATERWAY ROUTES AND VESSEL ALTERATIONS
AND SUBSTITUTIONS
All routes are subject to change without notice. Some
waterways may be subject to occasional closures due to drought, storms,
floods, canal or lock repairs or other unforeseen circumstances that result
in conditions unsafe for navigation. In the unlikely event of such occurrences,
the following conditions may apply:
(1) if navigation must be suspended, Passengers will continue
to be accommodated on the stationary vessel and the regular excursions
will continue to be made, with cruising to be continued as soon as possible;
or
(2) RHONE CROISIERE may propose to reverse cruise route,
cruise another waterway or transfer Passengers to another vessel of similar
standard; or
(3) if none of the options (1) or (2) is applicable, RHONE
CROISIERE will provide the Passenger, without surcharge, with transportation
tickets to the departure or arrival transfer point or any other point agreed
by both parties.
ARBITRATION
Any controversy or claim arising out of or relating to
this Agreement, to your trip or to any material disseminated by RHONE CROISIERE
concerning your trip shall be resolved solely and exclusively under the
French law.
INSURANCE
The professional insurance is taken out to AXA assurances,
Agent général Annick PECOUT, résidence les Baumes
– 13800 ISTRES – FRANCE.
PHOTOGRAPHY ON TOURS
RHONE CROISIERE reserves the right to take both still
and film or video pictures and record sound during any cruise tour and
to use such Pictures and/or Sound Recordings for promotional and advertising
purposes. The Passenger hereby permits RHONE CROISIERE to use his/her image
and voice in such Pictures and Sound Recordings without any payment due
to the Passenger whatsoever. The Passenger must notify RHONE CROISIERE
in writing that he/she does not grant RHONE CROISIERE permission to use
such Pictures and Sound Recordings.
RESPONSIBILITY CLAUSE
All Passenger’s possessions are carried at his/her own
risk. We do not recommend that Passenger brings valuable jewelry or large
amount of cash. Passenger understands and agrees that RHONE CROISIERE is
not responsible for injury, death, property damage, delay, inconvenience
or loss occasioned by theft or vandalism, fire, water, weather conditions,
terrorist activity, acts of God, strikes or other labor unrest, riots,
governmental acts, maintenance, cleanliness, sanitation or other problems
with vessels or transportation mechanisms, delays of airlines or any other
transportation mechanism.
GENERAL INFORMATION
Consumption of food and beverages from outside is not
allowed on board. This agreement and contract supersedes and cancels all
prior communications and agreements whether written, oral or implied. No
provision in this agreement can be modified except upon a writing, signed
by an officer of RHONE CROISIERE. RHONE CROISIERE reserves the right
to refuse to accept or retain as a member of a tour any person at any time
; Upon booking and payment for any cruise tour, this Agreement shall be
deemed transacted in France. Any inquiries, claims or general complaints
by the Passenger relating to the services provided by RHONE CROISIERE must
be submitted in writing to RHONE CROISIERE within thirty (30) days of the
completion of the tour and cruise, and must contain detailed and evidentiary
information. |
